Lawsuit Against Township Tossed Out

A judge has tossed out a lawsuit filed by South Morgan Acres, a proposed large-scale hog operation, against Blandinsville Township.

Last month, the township set a weight limit of 20 tons on the road leading to the site in northeast McDonough County. The limit prevents large trucks from getting to the site.

The lawsuit alleges the operation has suffered a financial loss of at least $230,000 since that time.

Beverly Braniff lives near the site of the hog farm. She does not think the lawsuit was filed over the money lost.

Keokuk Nursing Home Joins Lawsuit

District Court Judge John Wright has ruled that Lexington Square will be able to intervene in a lawsuit involving the Keokuk Board of Adjustment.

The Board of Adjustment is being sued by 17 individual neighbors of the nursing home over the panel’s decision to allow Lexington Square to expand its facility.

Lexington Square wanted to enter the lawsuit because of the impact the final ruling would have on its operations.  The nursing home is looking to add more private rooms without increasing its bed count.

Judge Rules in Favor of City

Former Fort Madison Police Officer William Bowker will not be returning to the department.  He was fired by City Manager Byron Smith on Feb. 25, 2010.

Smith cited various acts of misconduct.  They include falling asleep and/or missing phone calls while serving on the Southeast Iowa Narcotics Task Force and having an affair with the wife of Police Chief Bruce Niggemeyer.

Bowker appealed the ruling to the Fort Madison Civil Service Commission.  That panel sided with the city in mid-2010, prompting Bowker to sue the city and the commission in district court.
