RUSS Sues Engineer over Argyle Sewer

A lawsuit has been filed in Henry County (IA) over a sewer system in Lee County.

Regional Utility Service Systems (RUSS) hired Warner Engineering in 2007 to develop the system currently operating in the unincorporated community of Argyle.

RUSS has worked with more than a dozen small communities in southeast Iowa to find the money needed to pay for new sewer systems.

The Mt. Pleasant-based organization owns and operates the systems after they are constructed.

RUSS filed the lawsuit against Warner Engineering on Oct. 3.

The organization says Warner Engineering failed to complete its work in a good and workmanlike manner.

It says, as a result, Argyle's system is defective and in need of repair.

RUSS says the system is overloaded hydraulically and organically and does not meet state code regarding sand filters.

The organization is seeking financial compensation plus interest and legal fees, though a specific dollar figure is not mentioned.

Warner Engineering has yet to respond to the lawsuit.
