Keokuk Files Injunction Against IA National Guard

Keokuk, IA – Keokuk wants the courts to force the Iowa National Guard to build a taller fence around its armory.

Keokuk filed a petition for declaratory judgment and a temporary injunction against the Iowa National Guard in district court. The city says the new barbed-wire fence violates city code and a previous ruling by the Keokuk Board of Adjustment.

City Attorney Tom Marion says the barbed-wire should start at the 8' mark, not the 6' mark. He says Keokuk is asking for the barbed-wire portion of the fence to be removed.

"We are serving the state's attorney general, the local Iowa National Guard, and the head office in Johnston, Iowa," says Marion, "so it may very well be that we can negotiate something."

Marion says a judge must act upon Keokuk's filings. He hopes a hearing date can soon be finalized.

Representatives of the Iowa National Guard were unaware of the filings when contacted Wednesday afternoon. They would not be able to comment on the fence until they received the court documents.
